Work resumes on Long Pond subdivision after appeal against it fails

The appeal has been rejected, the Stop Work order has been lifted and the diggers are back on the grounds of a new subdivision being built behind Dawe’s Plumbing and Greco Pizza in Manuels, CBS.
The Appeal Board’s decision to back the Town’s approval of the project was the first item on the agenda of the planning committee when its chairman, Ward 3 councillor Gerard Tilley, presented its report at last Tuesday’s public council meeting.
The subdivision, which comprises about two dozen lots, begins at 163-165 and 177 Conception Bay Highway and runs back to a southern boundary near the T’Railway and as far west as 35-39 Talcville Road.
Tilley noted the motion to rescind the Stop Work order was transferred from council’s private committee-of the whole meeting held earlier in the evening.
“As I’m sure everyone is aware, we entered into a subdivision agreement with a developer for a particular piece of property,” Tilley said. “Some nearby residents put in an appeal, which they have every right to do. There was a hearing, and the adjudicator ruled in favour of the Town. So, we’re just going to lift that Stop Work order now, and I believe work has already started again in that particular area.”
The appeal, which included a petition against the subdivision, was heard by the Eastern Regional Appeal Board on September 20. Adjudicator Garreth McGrath tendered his decision last week, ruling against the appellant, Juliana Dawe, though the Department of Municipal Affairs has yet to post it for public viewing.
In other development news:
Council has turned down a request for a variance at 1629-1631 Conception Bay Highway in Seal Cove because it isn’t necessary. The planning committee advised that complying with the development rules would not prejudice the building of a single-family home on the property as the owner intended.
An application to subdivide property and build a house at 139-149 Garden Road, Seal Cove was deferred. Tilley said the Town wants to wait until it receives the final report of a stormwater study on Billy Brook. “We just can’t allow any development in that area until we get the stormwater study back and have a chance to look at it,” he said.
Council has agreed to send an application to subdivide land for two building lots at 42-44 Seaview Place, Upper Gullies back to the planning committee for further discussion. The committee’s initial recommendation was to reject the application.
Council has approved an application to tear down a deteriorated building at 16 Dove Place off Worsley Drive in Chamberlains and replace it with a 1,500 square foot home.
An application for a commercial vehicle parking permit at 63 Red Bridge Road in Kelligrews was rejected. Tilley said the property does not have the minimum lot area and frontage to accommodate the request.
And finally, an application to open a medical business in the REMAX Realty Building at 434 Conception Bay Highway in Foxtrap was approved. No details were offered on the type of medical and professional services that will be available there.
