Holyrood okays Brophy’s Road subdivision plan

Holyrood council dealt with a number of permit applications during last month’s public meeting, and while most were given the green light, some were denied.


One application that was approved unanimously was a subdivision concept plan for Brophy’s Road.
Councillor Steve Winsor, who seconded the motion to approve a permit, pointed out the approval was for the plan, and not the actual subdivision.


“It’s excellent to see developers are keen here, and for us as council, we welcome that,” said Winsor. “But this is a concept and is subject to all the regulations and subject to formal binding, legal agreements being put into place.”


Council refused an application for a home extension at a Golden Eagle Way property as staff found it in contravention of the Town’s development regulations, which state that properties situated on existing corner lots shall be deemed to have two street frontages and shall be required to maintain the minimum building line setback on both the primary and flanking street.


“The key point here is the setback, meaning the distance from that road,” said Winsor. “So, the proposed extension to the home would bring that property, effectively, too close (to the road) and into a non-compliance situation.”


Council refused both an application to construct a home at 6 Salmonier Line as Town regulations demand a minimum lot frontage of 23 meters, while the lot boasted only 19.998 meters, and an application to construct a dwelling at 209-211 Conception Bay Highway as council had already approved the construction of a home on the lot. In the latter case, Winsor said he believed the applicants intended to live in the smaller dwelling while construction of the main house was ongoing.


“But the regulations say that only one property can exist on a lot at one time,” noted Winsor. “I’m surmising here, but there could be a demolition permit application to follow.”


The lot, said Winsor, is not subdivided.


Finally, council refused a water connection as the applicant’s home is not within the Town boundaries.
