CBS worksite injury results in charges

Nova Scotia-based companies Hurricane Industrial Equipment Incorporated and Blue Water Agencies Limited have been charged with violations under Newfoundland and Labrador’s Occupational Health and Safety (OHS) Act and Regulations.

The charges result from an investigation by the Department of Digital Government and Service NL’s Occupational Health and Safety Division into an incident which occurred in July 2020, resulting in serious injuries to an employee of Hurricane Industrial at Blue Water’s worksite in Conception Bay South.

Hurricane Industrial Equipment is charged with two violations under the OHS Act and Regulations relating to its alleged failure to provide a safe workplace, and the necessary equipment, systems and tools that are without risk to workers, and for failing to make sure safe work procedures were followed at the workplace.

Blue Water Agencies is charged with two violations of the OHS Act and Regulations relating to its alleged failure to ensure, as the principal contractor, that employers and workers performing work complied with the OHS Act and Regulations, and for not ensuring that its OHS Program was implemented, in particular with respect to contractors.

The companies’ first appearance is scheduled for May 16, at Provincial Court in St. John’s.
